This Privacy Policy describes how we collect, use, and disclose personal information that we may collect anytime you interact with us including when you visit our website and any of our other online properties (collectively, the “Site”), contact us or subscribe to our communications. Any capitalized terms not defined herein shall have the same meaning given to them in ESX’s Terms of Use Policy.

We collect your personal information because it helps us stay in contact with you and enables us to give you convenient access to our offerings. - Internet or other similar network information, such as IP address, browser type and version, type of device you use, operating system version, and device identifier, geographic location, pages you view, how you got to the Site and any links you click on to leave the Site, metadata and user behavioral metrics about your use of the Site and emails we send to you (including clicks and opens), and metadata about how you interact with the Site;
- Inferences and preference information, such as the type of resources, topics, trainings, or communications that may be of interest to you, derived from interactions with the Site, events, or emails.

For example, when you subscribe to newsletters or email alerts, register for events or trainings, or submit resources for possible inclusion in our Resource Library (a collection of election-security materials that we review and may publish on the Site), the types of information we collect may include your name, email address, telephone number, office or organization name, and any additional information you choose to provide as part of your submission. You may elect not to provide this information but doing so may prevent you from using or accessing our offerings or the Site’s full features.

- To service providers & vendors. We disclose personal information to service providers and vendors that help us with our business activities. Service providers support us in processing the types of personal information described above, for the purposes described in this Privacy Policy. They are only authorized to process that information as necessary and as directed by us.
- To partners. We develop relationships with a variety of partners, to whom we may disclose your information for one of the purposes described above. We permit our partners to process your information only as necessary and as directed by us. We may also obtain your information if one of our partners discloses it to us, in which case we will respect the terms of their privacy policy in addition to applying ours.
- Sharing of personal information through third-party cookies and similar technologies. We do not sell your personal information for money. When you interact with the Site, we may use or authorize third-party partners and service providers to use cookies, web beacons, and similar technologies to improve your experience with us. - Right to Request Deletion: The right to request that we delete any of your personal information that we collected from you and retained.
- Right of Portability: The right to request a copy of your information in an accessible format.
- Right to Correct: The right to correct inaccurate personal information that we maintain about you.
- Right to Opt Out of Targeted Advertising, the Sale or Sharing of Your Personal Information, and Profiling in Certain Circumstances: The right to direct us not to sell or share personal information we have collected about you to third parties for targeted advertising. In addition to requesting to exercise this right through the standard request process below, you may also effectuate it by managing your cookie preferences or by clicking on the “Data Privacy Request” link on the Site
- Right to Non-Discrimination: The right to not receive discriminatory treatment for exercising these rights.
- “Shine the Light:” California Civil Code Section 1798.83 permits individuals to which the law applies to request information regarding the disclosure of your personal information to a third party for the third party’s direct marketing purposes.
- Right to Appeal: The right to appeal our decision regarding your request within a reasonable time period dependent on applicable law.
- Marketing Opt-Out: You may opt out of receiving future marketing communication from us by using the unsubscribe link at the bottom of email communications from us or taking other steps to opt out that we make available to you. We will use commercially reasonable efforts to process such requests in a timely manner.

Again, please note that when applicable laws do not require us to address a request, we retain the right to fulfill, deny, or otherwise respond to it at our sole discretion. If we choose to fulfill or respond to a request, we may have to require verification before allowing you to exercise certain rights requests. We may request up to three (3) pieces of personal information about you, and we reserve the right to take additional steps as necessary to verify your identity if we have reason to believe a request is fraudulent. Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. We may not be able to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. If we are required to respond to or act on your request, we will do so within the time limits under applicable law.
8. Information of Minors
The Site is not intended for and we do not knowingly collect personal information from individuals under the age of 18. If we learn that we have collected personal information from an individual under the age of 18 without parental consent, we will delete that information and otherwise comply with the requirements of the applicable law. ESX takes precautions—including administrative, technical, and physical measures—designed to safeguard your personal information. Please keep in mind that the transmission of information over the internet and on mobile platforms is not always secure, which means we cannot and do not guarantee the security or confidentiality of any personal information you provide to us. Given this reality, your use of our services, and your decision to provide personal information to us, is at your own risk.

ESX will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Please be aware that other websites and services, even when accessed through the Site such as by a link, may have different privacy practices and may collect personally identifiable information about you.
